General terms and conditions

These general terms and conditions determine the terms of use and purchase through the online store E-sports Trgovina, which is accessible at the link www.esportshop.si and is operated by Miha Praviček s.p.

These general terms and conditions apply to the entire website, all its components and subpages. By using the website, the user accepts and agrees to all provisions of these general terms and conditions, which also include all links as their integral parts. The terms and conditions of business have been drawn up taking into account all legal obligations and international guidelines for e-commerce, which are also represented by the Slovenian Consumers’ Association.

Summary of legislation on access to information

The provider undertakes to provide the buyer with the following information:

  • company identity (name and registered office, registration number),
  • contact details that enable the user to communicate quickly and effectively (telephone, e-mail),
  • terms of delivery of items (method, place and delivery time),
  • method of payment and delivery,
  • time validity of the offer,
  • essential characteristics of the goods (including guarantees),
  • all prices must be clearly and unambiguously specified and it must be clearly shown whether they already include taxes and delivery costs,
  • explanation of the complaint procedure, including all contact information.

Registered members – users

Each registered user has their own username and password, with which they present themselves personally or as a representative of a company or organization. The password is secret and known only to the user. The user is obliged to provide authentic data and data protection, so that only they or a person authorized to act on their behalf will act in their name and with their password.

Prices

All prices on the website are expressed in euros (EUR) and are final. All prices displayed on the website are subject to change without prior notice.
The purchase contract between the provider and the buyer is concluded at the moment the provider confirms receipt of the order, namely by e-mail sent to the buyer’s e-mail address. From this moment on, all prices and other conditions are binding for both the provider and the buyer.

These general terms and conditions are an integral part of the contract.

Complaints

In cases where If there is something wrong with the product you received to the extent that you want to exchange it, you can return it to our address. This only applies to products with a material defect: when the item does not have the properties that allow its normal use or when the customer is given an item that does not match the model. The products you are returning should be unused, undamaged or as you received them and in the original packaging, otherwise, in the event of your return of the product, we will charge you appropriate compensation, which will be assessed with a report upon return of the goods. More about this in the Return of products section. When returning, be sure to include a copy of the invoice and the return form. If you send us a product without an invoice and a correctly completed return form, we will ask you for the missing documentation by e-mail. Please note that the date of receipt of the product is the date on which we receive the product and all required documentation. In cases where you do not deliver the required documentation within 7 days of submitting our notification, we will return the product to you at your expense.
The provisions of the previous paragraph also apply mutatis mutandis to all purchases by companies and other legal entities and to consumers who did not make the purchase by concluding a distance contract and wish to withdraw from the contract. In the event of a complaint about the purchased product, the buyer returns the product to the seller at his own expense. Shipping costs are always covered by the sender, unless otherwise agreed in advance. We do not accept shipments with a ransom. We will check the justification of your complaint and inform you within 8 days about the result of the procedure and further steps.

Warranty and Authorized Service

All products have a warranty from the importer or manufacturer and guaranteed servicing and spare parts in Slovenia. When exercising the warranty, the warranty conditions stated on the warranty card attached to each product apply. You will receive a list of authorized service centers for your product with the product. To exercise the warranty and service maintenance and additional information about warranty repairs, you can contact the nearest authorized service center.
You can exercise the warranty with the warranty card, invoice and other documents stated on the invoice!
Do you have an unconfirmed warranty card? Don’t worry! In this case, in accordance with Article 18 of the Consumer Protection Act, you do not need a warranty card confirmed by the seller.
When exercising your rights under the warranty at authorized service centers, please note that the warranty generally does not apply to: consumables, batteries, Ni-Cd, NiMH and other accumulators, bulbs, fuses, electronic components and the like.

The warranty is void in the following cases:

  • defects caused by improper use, careless handling, mechanical damage and damage due to force majeure (power surge, lightning, etc.);
  • if the product has been tampered with by an unauthorized person or if it is determined that someone has tampered with the product without our written permission;
  • in the event of modifications to the device;
  • in the event of unprofessional addition of structural assemblies, arbitrary wiring of elements such as switches, potentiometers, plugs, etc.;
  • in the event of use of other elements that do not originally belong to the device;
  • in the event of damage due to interference by third parties;
  • in the event of connection to the wrong voltage or type of current;
  • in the event of incorrect operation or damage due to careless handling.

MATERIAL DEFECTS
Major defects are very rare in practice. If you believe that the purchased products did not have the properties necessary for their normal use or circulation at the time of purchase and in other cases defined as material defects by the Consumer Protection Act, and you inform us of this correctly and no later than within two months from the date on which the defect was discovered, you can request that:

  • we eliminate the material defect in the product free of charge or
  • refund a part of the amount paid in proportion to the material defect or
  • replace the product with a material defect with new, flawless goods or
  • refund the full amount paid.

You must deliver the product to us for inspection. Please attach a return form to the product, so that the process will run faster. In the event of a complaint about a purchased product, the buyer returns the product to the seller at his own expense. When sending the product to our address, please note that shipping costs are always covered by the sender, unless otherwise agreed in advance. We do not accept shipments with a ransom.
In cases where the reported defect is not disputed, we will grant the request within eight days of receiving the product for inspection. Otherwise, within eight days of receiving the product at the headquarters of the Tesma sport d.o.o. administrator, we will inform you in writing that the defect is disputed.
Attention! In cases where the reported material defect in the product is disputed, after completing the procedure, we will return the product to you in the same condition as it was received. If you wish to exercise the guarantee for the flawless operation of the product, you can continue this at an authorized service center after receiving the product from us.

Execution or rejection of the order

E-Sports workshop will begin the activities necessary to execute accepted orders as soon as possible. We will notify you of the start of the execution of your order by sending a message to your email address.
E-Sports workshop may reject an order for which it determines that it cannot execute it under the stated conditions.

Disputes arising from the use of the website services, these general terms and conditions and in relation to the company E-Sports Workshop shall be governed exclusively by the law of the Republic of Slovenia. All parties to the agreement, regardless of their actual geographical location, nationality or affiliation, agree that within the framework of this service they are bound exclusively by the law of the Republic of Slovenia. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply to disputes relating to this agreement. The courts of Maribor shall have exclusive jurisdiction over all disputes and legal proceedings relating to this agreement, the use of the service and the operation of the service.

The Administrator reserves the right to change the terms of access to the services for members and users at any time with effect from the date of publication of the change.

Order cancellation

After placing the order, the buyer receives an email notification that the order has been accepted. The message contains a summary of the order and all necessary information for the buyer about the further purchase process. The message is considered an informative pro forma invoice. At this stage, the buyer has the opportunity to cancel the order within one hour.

The order can be canceled exclusively via email to info@esportshop.si.
The following information must be provided in the email:

  • In the message title: Order cancellation
  • In the message content:
    • Buyer’s name and surname
    • Buyer’s address
    • Order number

Withdrawal from the contract and return of goods

In the event that after receiving the goods, the item received is not to the consumer’s liking or the consumer is not satisfied with the item, the consumer has the right to notify the provider in writing within 14 days from the date the consumer received the goods that he or she is withdrawing from the contract. In this case, the consumer does not need to state the reasons for his or her decision. The message is considered to be timely if the shipment is delivered within the deadline.

The right to withdraw from the contract does not apply to items made to order.

The buyer can inform us of the intended return no later than 14 days from the receipt of the goods to the e-mail address: info@esportshop.si

Returning the received goods to the specified address within 14 days from receipt, without prior written notice, is also considered a withdrawal from the purchase.

Consumers return the products by registered mail, together with the attached invoice, no later than 30 days from the notification of withdrawal to the provider’s address: E-SPORTS, Miha Praviček s.p., Sršakova ulica 1, 2311 Hoče.

All costs associated with the return of products are paid by the buyer. We do NOT accept shipments with a redemption fee for returned products.

The buyer must return the products undamaged, in unchanged quantity and in the original undamaged packaging. An invoice must be enclosed. Although this is not mandatory, we will be happy to state the reason for the return. We are not responsible for costs incurred due to behavior outside the terms of business.

If the buyer withdraws from the contract in accordance with the provisions, the provider will refund all payments made. The refund will be made as soon as possible, but no later than 30 days after receiving the message about withdrawal from the contract and return of the product. If you express a desire to refund the purchase price, we will refund it exclusively via transfer to your personal bank account, which you must notify us in writing during the return process.

Payment method

The consumer can pay for the ordered goods in the online store in the following ways:

  • Payment by pro forma invoice: you can pay for the ordered goods by pro forma invoice, which you will receive to your e-mail address upon completion of the order. You can pay the pro forma invoice through any online bank or by paying the payment slip at the bank or post office. The shipment will only be shipped when your transfer is visible on our transaction account. This is the same or the next day, depending on the bank and the time of the transfer.
  • Payment upon receipt: you pay for the ordered goods in cash to the delivery service upon receipt of the shipment.
  • Payment card: you pay for the ordered goods with a payment card online.

Not all payment methods are available for all delivery methods. Payment methods may change without prior notice depending on the customer’s location, delivery address, or the current situation.

Delivery

We deliver all packages by our own delivery or in cooperation with the GLS delivery service

The delivery cost is calculated according to the currently valid price list and is visible at the end of the purchase.

When paying BY SUMMARY, you will also be charged a commission or a delivery service fee. The service is paid upon receipt of the package directly to the delivery service, according to the currently valid price list of the delivery service. The cost of the fee service is not included in the value of the package.

Usually, during working days, the goods ordered are delivered to the recipient’s address within a day or two of the dispatch of the goods. During holidays and weekends, the delivery period is extended accordingly for the time of the non-working days. The delivery period is also extended in the event of extraordinary circumstances.

Warning: these conditions and packaging and delivery costs apply only within the Republic of Slovenia.

The delivery cost for orders worth up to 100 EUR is 5 EUR (regular delivery with GLS).
The exception is packages or products that require special handling due to their dimensions, weight or other special characteristics. For these exceptional shipments, the delivery price is charged according to the currently valid price list or is calculated:

Security of personal data

The provider undertakes to permanently protect all personal data of the user.
The provider stores the IP addresses of all visitors for an indefinite period, and for registered members: name and surname, e-mail address, contact telephone number, primary address and delivery addresses, country of residence, time and date of registration and archive of communication with the provider.

The provider will use personal data exclusively for the purposes of fulfilling the order (sending information materials, offers, invoices) and other necessary communication. The user’s data will not be handed over to unauthorized persons under any circumstances. The user himself is also responsible for protecting personal data, namely by ensuring the security of his username and password and by using the appropriate software when (antivirus) protection of your computer.

Disclaimer

The provider does its best to ensure that the information published on its pages is up-to-date and correct. However, the characteristics of the items, the delivery date or the price may change so quickly that the provider is unable to correct the information on the website. In such a case, the provider will inform the buyer of the changes and allow him to withdraw from the order or replace the ordered item.

Although the provider tries to provide accurate photos of the items for sale, all photos should be taken as symbolic. Photos do not guarantee the characteristics of the item.

The provider has the option to withdraw from the contract with the customer only if an obvious error is found (Article 46 of the Civil Code). An obvious error is defined as the essential characteristics of the item and all errors that are considered decisive according to the customs of trade or the intention of the parties and that the provider would not have confirmed or concluded the contract if it had been aware of them. This also includes obvious errors in the price.

The provider reserves the right to change the terms and conditions at any time and in any way, regardless of the reason and without prior notice.
